Thanks for choosing to work with Evening Sky Design! We try to make our Terms & Conditions as transparent as possible. If you have any questions or concerns about our Terms & Conditions, please feel free to contact us directly via the Contact Us form.

 

Terms and Conditions

  1. Before we begin the actual work, we require a 50% deposit. If you cancel your project before we begin, your deposit will be refunded minus 3.9% to cover all financial costs charged by PayPal.  If work has begun on your project, the deposit is nonrefundable.

  2. For all projects, we send you a mockup of the website once all the information needed is collected. First drafts are sent within the number of business days specified for that project. Upon your approval, we move on to the creation of your final website.

  3. Once your project is finalized, we will invoice you for the outstanding balance, and payment in full is required before we transfer your completed website to you.​

  4. We fix all errors free of charge. Any changes requested by the website owner are charged at the fee determined at the onset of the project. 

  5. Evening Sky design is not liable for any errors or losses that may arise through the information published on your website.  

  6. Once you approve the final website, you agree that you’re 100% satisfied with the final site including any errors/typos/defects whatsoever.

 

Cancellations

  1. Evening Sky Design reserves the right to cancel a project at any time without notice. If Evening Sky design chooses to cancel a project, then any amounts paid (less the Pay Pal fee) will be refunded in full.

  2. If you cancel your order before we begin any work, we will refund your deposit in full. If work has begun on your project, your deposit is nonrefundable. For partial cancellations, extras, or changes that haven’t begun, your payment amount due will be adjusted accordingly on the final invoice. If you order other services as a package and receive a discount, then choose to cancel one or the other, the amount of the order will be adjusted accordingly to reflect the change.

  3. If there is a breakdown in communication and no contact is made after 60 days, then we will assume you have abandoned your order and your deposit is non-refundable.

  4. If your original order changes in any way, then Evening Sky Design reserves the right to cancel your order. If work has begun on your project, the deposit is non-refundable.

Communication

  1. Changes must be requested via email and agreed to by both parties.

  2. Changes agreed to by both parties will result in additional time on the order. The client will be advised of the additional time at the time of the agreement.

 

Confidentiality

  1. We take your confidentiality seriously at Evening Sky Design. All materials and communications are for use by Evening Sky Design for the completion of your order only. We will not share your information or property with any third parties unless you approve it as per our Privacy Policy.

  2. If requested, Evening Sky Design will agree to sign a nondisclosure agreement prepared by you at your expense.
